Conditions for using the EventPics app and web app

1. Scope & Provider

These Terms of Service govern the use of the EventPics platform (app and web app) by consumers and businesses.

EventPics is operated by Aigner Software e. U. (owner: Matthias Manuel Aigner), Hauptplatz 23, 4190 Bad Leonfelden, Austria. "EventPics" refers to this legal entity and its services throughout these Terms.

2. Services

EventPics provides event/album creation, collecting photos/videos from guests, managing/sharing content, and download features. The feature set may vary by plan; free plans or beta features may be changed or discontinued at any time.

3. Accounts, minimum age & responsibility

  • An account is required only for organisers creating an event; guests can use events without an account.
  • Minimum age to create an account/create an event: 16 years or as required by local law.
  • By signing in (registering) in the app or web app, you accept these Terms, including the Data Processing Agreement (Section 5). You are informed of this before signing in, with a link to these Terms.
  • You are responsible for safeguarding your credentials and the content in your event.

4. Content, rights & consents

  • You retain all rights in your content. You grant EventPics a non‑exclusive, worldwide licence to store, process, deliver to authorised persons and back up the content for operating the service.
  • You ensure you have the necessary rights/consents from third parties (especially people depicted) and fulfil all information duties – including under GDPR – towards your guests; EventPics is not the event organiser and not the controller with respect to your guests.
  • Guests who upload content without an account confirm that they hold the required usage, copyright and personality rights and do not infringe privacy or other rights.
  • Unlawful content is prohibited, in particular pornographic, violence‑glorifying, extremist, discriminatory or otherwise harmful‑to‑minors content.
  • It is forbidden to upload or distribute content for which you do not hold the necessary usage/copyright rights or which infringes third‑party rights.

5. Data protection & data processing agreement (DPA)

  • Where EventPics processes personal data on your behalf when you use the platform (in particular photos and videos in your events), the Data Processing Agreement (DPA) pursuant to Art. 28 GDPR, in its current version, forms part of these Terms.
  • The DPA is concluded electronically when you accept these Terms (Art. 28(9) GDPR). A separate signature is not required.
  • EventPics is itself the controller for account data, billing, security and operating the platform; see the Privacy Policy for details.

6. Pricing, term & cancellation

  • Free plan with storage and retention periods per pricing. Premium features are paid and offered as a subscription.
  • A subscription can be purchased in three ways: in the iPhone or iPad app via Apple, in the Android app via Google Play, or in the browser via our payment provider Paddle.
  • Purchase in the app: billing, renewal and cancellation are handled by Apple or Google under their terms. You cancel in the subscription settings of the respective app store.
  • Purchase in the browser: the seller is Paddle.com as merchant of record. The Paddle Buyer Terms apply in addition. You cancel in the app or web app under “Manage / cancel subscription”.
  • Subscriptions renew automatically for the chosen term (monthly or yearly) unless cancelled before the end of the current term. After cancelling, the premium features remain available until the end of the paid term. Instructions for all three ways are available under Cancel subscription.
  • Deleting your account does not cancel a running subscription.
  • Statutory consumer withdrawal rights remain unaffected.

7. Storage periods, deletion & backups

  • Content is deleted automatically depending on the plan: in the Free plan after the event phase ends (6 weeks after an immediate start; 4 weeks after the event date for a scheduled event); in paid plans after the end of the paid term and a subsequent period of 12 days (see Cancel subscription).
  • When deleting an event or account, content is removed according to technical and legal requirements; backups/logs may persist for a limited time for security and compliance before being overwritten. Restoration of deleted content is generally not possible.
  • EventPics does not guarantee individual backups. Please back up important content yourself.

8. Acceptable use

Abuse of the services, circumvention of security, unauthorised automated access (bots) or infringement of third‑party rights is prohibited. EventPics may suspend accounts/events or remove content in case of violations.

9. Event links & QR codes

Event links and QR codes can be used by anyone who has access to them. The organiser is responsible for sharing them and for the chosen visibility/upload settings.

10. Availability

We strive for high availability. Maintenance and outages may occur; no specific SLA is guaranteed.

11. API use

The API is subject to the technical limits and requirements of the documentation. Abuse (e.g. unauthorised mass uploads) is prohibited. If limits are exceeded or in case of abuse, EventPics may suspend API keys, throttle rates or restrict access; API availability may differ and is not guaranteed.

12. Liability

EventPics is liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise, liability for slight negligence – except for breach of material contractual obligations – is excluded; in that case it is limited to typical, foreseeable damage.

13. Indemnity for violations

If you culpably violate these terms, you indemnify EventPics against all third‑party claims, including reasonable legal costs.

14. Reporting unlawful content

Please report unlawful content by email to [email protected]. We review reports and take appropriate action.

15. Governing law

Austrian law applies, excluding its conflict‑of‑law rules. Mandatory consumer protection of your place of residence remains unaffected. For business users, the place of jurisdiction is Linz, Austria.

16. Changes

We may amend these terms, e.g. for new features or legal changes. We will reasonably inform you of material changes.
